Regulations for Appreciation Awards
Definition of terms
Article 1.- Definition of terms
For the purposes of the LUYA Appreciation Awards Regulations offered on the websites www.luya18k.com and www.luya18k.myshopify.com (hereinafter the “Regulations”), the most important concepts that must be taken into consideration are listed below:
(a) Website: The websites, whose domains are: www.luya18k.com and www.luya18k.myshopify.com , where www.luya18k.com is the official website and www.luya18k.myshopify.com is the official store, created for the purpose of offering its products and services to subscribers.
(b) Subscriber User: This is the natural person, over 18 years of age residing in Peru or natural persons from other countries, considered to be of legal age in their respective jurisdiction, who registers on the Website, who voluntarily and with full knowledge of the content of this Regulation, decides to participate in the Appreciation Awards made by LUYA on the Website, and who has the status of Subscriber User, in accordance with and prior acceptance of the terms and conditions of the Website at the time of their registration, by having an active monthly subscription.
(c) LUYA Appreciation Award: This involves a procedure in which one Subscriber User is randomly selected, provided they have an active monthly subscription. If this Subscriber User has strictly complied with the terms of these Regulations, they will win and receive the LUYA Appreciation Award. To participate in the LUYA Appreciation Award, you must be a Subscriber User with an active monthly subscription.
(d) Regulations: These Regulations, which are intended to establish the conditions governing the LUYA Appreciation Awards.
Participant Eligibility and Rights
Article 2.- Only natural persons over 18 years of age residing in Peru or natural persons from other countries, considered to be of legal age in their respective jurisdiction, who are Subscribing Users and have an active monthly subscription on the Website, may participate in the LUYA Appreciation Awards.
Participation in the LUYA Appreciation Award implies, on the part of the participant, knowledge of the Regulations and instructions of the LUYA Appreciation Award, as well as adherence to what is established therein, and any type of request or claim based on ignorance or lack of knowledge is unacceptable.
Article 3.- To participate in the LUYA Appreciation Awards and be eligible to win the prizes offered, the Subscribing User must have an active monthly subscription on the Website.
Article 4.- In recognition of the support of the Users Subscribing to the Website, LUYA will make at least one (1) monthly Appreciation Award.
Notwithstanding the foregoing, the number of LUYA Appreciation Awards may be increased progressively; LUYA reserves this right.
LUYA Appreciation Award Celebration and Winner Selection
Article 5.- The LUYA Appreciation Awards will be held and the winners announced on the Website at the date and time specified on the site and social media.
Article 6.- The winners of the prizes offered will be the participants who, having fulfilled all the requirements established in this Regulation, that is, being Subscribing Users and having an active monthly, semi-annual or annual subscription, have been chosen by the designated random selection system.
In addition, in accordance with the Website's Terms and Conditions and Privacy Policy, any partial or total modifications to these documents will be communicated to the Subscribing User through a posting on the Website for their acceptance. If the Subscribing User does not agree with the modifications, LUYA will suspend the use of their account.
Notwithstanding the foregoing, if you have not logged into your Account by the day you become a winner, you will need to accept the corresponding modifications at that time to be eligible for the prizes offered. Otherwise, you will not be eligible for the prizes offered.
Article 7.- The list of Subscribing Users, which will be used to make the LUYA Appreciation award on the Website, on the date and time of the celebration, will be the database of active Subscribing Users managed by LUYA.
Award delivery and payment
Article 8.- For the delivery of the prizes, the winner will be contacted through the email address and telephone number provided at the time of their registration as a Subscribing User on the Website.
The winner, under their own responsibility, must respond to LUYA's communication within a maximum of seven (7) calendar days from the date this communication was sent. If they fail to respond, LUYA reserves the right to award the prize to a second winner or to store it for a future LUYA Appreciation prize.
On the day and at the time of delivery, the winner must sign a delivery receipt and will be photographed with the prize. This will be understood as the winner's satisfaction with the condition and characteristics of the prize delivered.
Article 9. If the winner of a LUYA Appreciation Award is a Subscriber User who does not reside in Peru, LUYA will make every effort to deliver the award to the address provided by the winning Subscriber User. However, if this is not possible, either because the shipping cost exceeds LUYA's budget, the winner will receive a cash amount equivalent to the prize price. This amount will be calculated based on the value of the purchase made by LUYA, whether in Peruvian soles or foreign currency. The final amount the winner receives will be the result of deducting bank, interbank, and/or any other type of commission/charge incurred at the time of sending and/or receiving the cash. LUYA assumes no responsibility for the exchange rate or currency conversion applied by the payment method used to send the cash at the time of sending and/or receiving it.
In either case, the delivery of the prize or its equivalent monetary amount will be coordinated via the email address and telephone number provided when you registered as a Subscriber on the Website. You will be updated every two weeks on the delivery progress.
Article 10. The winner of the LUYA Gratitude Award may choose whether their full real name, first name, or first and middle names (depending on what the user entered, which can be modified in the profile settings) is displayed along with their nickname, as provided at the time of their registration as a Subscriber User. They will also have the option to choose whether they want their face to be shown in the winner's public photo, or if they prefer not to. If they choose the latter, a mask or other symbol will be photoshopped onto their face to cover it and protect their identity.
Limitations of liability
Article 11.- Subscribing Users are solely responsible for their actions and the consequences that these generate, therefore, LUYA does not offer any guarantees of any kind.
Article 12. In the event of cancellation or postponement of the LUYA Appreciation Award, LUYA will not be liable for any resulting consequences. If such a cancellation or postponement occurs, information regarding the new date and time for the LUYA Appreciation Award ceremony will be provided and displayed on the interactive Events Calendar of the Website.
